It is possible to "interfile" in this situation, (See AFM Sec. 23.2(l) Transferring an Adjustment of Status Application from One Underlying Eligibility Basis to Another).
However, I do not think you can successfully interfile until your wife's 2010 PD is current. ( See AFM Sec. 23.2(l)(2)(L) The Priority Date must Be Current for the Basis to Which the Applicant Wishes to Convert).

Thank you for making it clear. I sent my I-140 towards the end of july, the receipt date is aug 6th. The case got transferred to TSC and then back to NSC on October 8th.

this is just me, i would not go anywhere other than fidelity or vanguard..research more in the internet.

Hi, My Lawyer says that texas SWA gave him a figure of $ 105,000 annual salary as a prevailing wage for 5 years experience java,j2ee guy.

It all boils down to the relationship you have with the employer and how flexible they are w.r.t immigration policies etc.
I know of people who were involved from day 1 till they filed 485 and I know of people who were not involved untill filing of 485 had to be done.
Your case it looks like that employer wont tell you if he has an approved 140. If that is true then you will only get involved when your PD is current- to file AOS.

As Silverlight is a browser side technology, you would have no problem serving Silverlight content from our servers as long as you add the proper MIME type settings to the site via .htaccess rules such as:
AddType application/xaml+xml .xaml
AddType application/x-silverlight-app .xap
AddType application/x-ms-xbap .xbap
HTTP responses have a "content-type" as apart of their header.

Examples are JPG, HTML, EXE.
It is advised to set the content type appropriately when you serve a file from your webserver by modiftying your htaccess file. To be honest, you can get away without setting this for all the popular browsers from my experience, but it might affect caching or obscure browsers negatively. There could be other implications, but none that I'm aware of.

To best of my knowledge, a person on EAD (probably not the primary candidate) can work for anyone.. It can be City, State, Federal or McDonald's at any position, part time or full time, provided the job does not involve any government classified information. Jobs involving classified information are only for citizens that too after proper background check.
Primary candidate might work for the government i.e. if job requires skills that citizens don't have and that group has a policy of filing H1's..

Hello all,
My I-140 was approved in EB2 with company B from TSC with PD:01/26/2004 and I-140 pending in EB2 with RFE in the present company A. I do not know at this point when it will be cleared. BTW receipt no# is with EAC. Does it mean it went to NSC for processing? It is high time for me to shift to company B on H1 transfer as per our understanding. Presently I am on 7th year extension and left with 2 months for 8th year ext.
Questions:
(1) Can I transfer to company B based on recent I-140 approval and get 3 year extension?
(2)If I have to get 3 year ext. I have to wait until I-140 is cleared from present company and then got for 3 year ext. then transfer to company B. But I guess it will be long wait and no one know what happens until the RFE is get okayed and I-140 will be approved. So my choice here is very limited in that aspect.
Crux of the problem is that I have better opportunities out side the present company and running short of time to make a firm decision to tell the present employer that I am looking out side which is very sensitive issue to handle on all other aspects.
I just received copy of I-140 approval notice from my attorney. So time is running out for me to make a decision in shifitng company from A to B.
I need your guidance and suggestions in making my future decisions?
