SDI is disability insurance you are mandated to insure during this kind of situations.
My wife is working on EAD. When we had baby (she had C-Section), she applied for SDI and she was paid. She asked her HR. HR mentioned SDI is nothing to do with immigration. Due to the company policy, We were forced to apply.
I know one of my friend who was benifitted with SDI and FMLA while he was on H1.

i transferred from one dept to another. the next dept filed for a H1B amend after 4 months. The lawyers filled in my G325 with the earlier, start date (and not the later filing date).

OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

My H1-B was approved in octubre 2008, I would like to go to my home country but i don't have a visa to be able to come back.
Now my question is:
Having an approved H1-b is a warranty for me to get a visa to come back to the US.
Also carry your educational docuements. They asked me last time when I went to stamping for my H1B Extension, in Feb 09. People over their in the Embassies looking in all means to stop giving the VISAs. So be prepared with all the documents.

Hi Guys
I was working with a company on H1b and i left to india for a vacation on aug 13 . got stuck in india due to some personal reasons.
I got paid till aug 30 as i had leave sanctioned till aug 30.
came back to US on dec 30.
Didnt get paid for the month of sept oct nov dec.
But i was never out of status as I was in india.
now can i apply for a h1b trasnfer as i m getting a job with a very good company with good salary.
i have paystubs till aug 30 2009. never out of status .

I have spent over 3 years in US. Can I file for H1B extension based on 6 years window for H1B visa. My situation is I am in India and the company is filing this fro me in US.
What are the chances of getting this extension approved?
1. I have maintained a legal status for 3 years during my stay in US.
2. 221g was the problem I couldnt get back to States.
3. 221g got cleared but my I 797 got expired and old company withdrew H1B extension.
4. Now one company is helping me with H1B extension based on my case as detailed above.

An H-1 would give you more flexibilty to change employers once you are here. However, the earliest that you could begin work here in H-1 status would be Oct. 1st of this year. With an L-1, you could presumably come right away. If an L-1A is possible, that could pave the way for a significantly easier and faster route to a green card.
Also, it is possible that in the not too distant future Congress could pass legislation to allow same sex spouses to confer derivative immigration benefits on each other. Check out the website: www.immigration equality.org

Now, can I take up a job with a different title - say, "Finance Analyst" or "Corporate Finance"? I have been talking to various clients in California that are interested in offering me finance positions.
You can, depends what you can give up for taking the finance job.
You may have to give up your PD depending on your status of immigration.

I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.
I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.
My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?

My friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.
What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??
Your friend and his co-worker has to find another job in same/similar field as soon as possible and file AC21 with the new employer.

My employer will not withdraw my I-140. Should I still go ahead with AC21 or should I just do change of address with USCIS?
I will be starting my new job pretty soon. Any useful suggestions appreciated.

First, its a very very wrong assumption that your employer will not withdraw I-140. Sometimes even if they don't want to, to comply with govt. regulations they gotta do it.
I would suggest not to get into a situation where you have to invoke AC21 till clouds are clear.

Hello,
Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

MTRs can take months or years. There is no 60-day processing time. The prior poster's answer of a few years is not unusual.
