Thanks for the response.
I do have some other questions as well :
1) So does it mean, if we apply for fresh h1 and once it's approved, we can stay for 3 years initially irrespective of L1 stay, for my case its' 13 months ? If not, how L1 stay affects initial h1 approval timings ?
2) If I apply for h1, let say in June'10, and once it's approved what could/should be my joining date with new employer ?
Thanks.

If you are born in UK and if you apply for labor certification under EB-2 category (job requirement: Master's degree or BS+5 yrs exp) then your priority dates are current and you can file for I-485 and get your GC in about 1.5 yrs...(ofcourse only if its not stuck under name check or any other complications...)

Does USCIS usually says this. i assume it should say "AP approved " or something similar. Have anyone seen this message on tracking your online case status.
Thanks for any info.

Hey, Your category has always been current. What are you doing on this forum.
Looks like this guy is from an anti-immigrant group.
Are you serious with your comment? Not from any anti-immigrant group here LOL. I just genuinely care for our collective future as immigrants. I know some people "close the golden door behind them", but not everyone does that

Hi,
I am a july 2 filer and I am in the same boat. I did call uscis and usually they give us the same answer that says we received your application on so and so and we will work on this. this is the latest and greatest information we have. I tried a different combination and found that my application has been moved to STORAGE facility. I am in the process of retriving that by sending Expedite request from lawyer.
Try this combination to know the status of your application.

This will connect you to immigration information officer who has access to the database and he can give you a good picture about your application. All the best

Hello,
I need some advice concerning my application for a B2 Tourist Visa to the US as my wife and I wish to travel to Disneyworld Florida next December to celebrate our belated honeymoon:
I received a police caution in March this year for "Battery" under Section 39 of The Criminal Justice Act after a domestic argument with my wife here in the UK.
I also have a UK driving conviction from 2006 for "Driving Without Due Care and Attention" which resulted in a 100 fine and six points on my licence which have now expired.
Do either of these cautions/convictions constitute a crime of "moral turpitude"?
I am rather concerned that although I have read that a simple assault/battery does NOT constitute "moral turpitude," spouse abuse certainly does under US law.
Does the definition of simple battery or spouse abuse depend on which country the caution was received in?
The incident in question was more of an argument than one of domestic violence. I grabbed my wife's arm and she twisted herself trying to get away from me and she fell over which left her with a minor bruise and scratch. I certainly did NOT use any deliberate force or physical violence towards my wife.
The argument arose because I had been unemployed for over a year and my wife was stuck doing a job she hates and financial difficulties at the time had put a strain on our relationship. Now that I have secured a full time job and our financial problems have depleted, the relationship between my wife and I is very stable and loving.
However, if the consular officer at the embassy decides that this is a crime of moral turpitude, would I still be eligible for "petty crime exemption" (as the maximum sentence for a Section 39 battery crime is six moths in jail) even though I have the driving conviction from 2006?
Any assistance and guidance on this matter would be greatly appreciated.

The employer has to always pay the H1B fees.
I know govt said anything regarding labor certifications etc are now only to be paid by employer...
what about fees related to extensions of h1 b? can i still pay for it or it's employer who has to pay...cause knowing my employer i know they won't want to pay and i wonder what options i have.

H-1B through non-profits like Universities does not have a cap. Your only bet would be to find a job through one such an entity and apply for H-1B. Then you can pursue H-1B through any commercial entity during 2008 quota starting from April 2007.

Hello EliteG000,
Unless the animation is created in another application such as illustrator, the files size for anything created within Swift such as text, squares, etc. take up a lot of space. But when I do use 3D in Flash (I don't use 3D all that much), I use Swift 3d.
When I publish the Swift 3D SWF file and import it into Flash, I often delete a keyframe from the animation every 2 or 3 frames. Each keyframe in a Swift animation is about 3-8KB each. For a fairly large 3d Shape that is being rotated, the file size could balloon even more. Anyway, deleting a few random frames does not degrade too much from the animation.
To help reduce the file size, I also select each frame of the Swift animation in Flash, and press the Smooth or Straighten buttons. That helps remove some of the extraneous artifacts that might degrade the look of the animation as well as take up a lot of space. I also Optimize the animation by removing extra curves, etc. by going to Modify | Optimize. Optimize is similar to using the Smooth and Straighten icons at times!

It appears like USCIS is finally reviewing the option of issuing Multi-Year EAD's..
Please see Memo release from USCIS
Source :
http://www.immigration-law.com/
1.
Question: During a recent meeting, USCIS stated that it hoped this summer to introduce multi-year EADs for I-485 applicants whose cases were backlogged. Please provide more information about the types of applicants that would be eligible for such EADs?
2.
Response: A proposal is currently under review by USCIS program offices to issue a multi-year employment authorization document to those applicants affected by visa retrogression. If this proposal is adopted, it will apply to adjustment of status applicants.
3.
Question: Please explain what USCIS means in this context by the term backlogged does it refer only to cases pending more than a certain number of months where applicants are filing for renewal EADs?
Response: USCIS is considering issuing multi-year EADs to those applicants affected by visa retrogression. Further information will be provided once a final decision is made.
4.
Question: Will I-485 applicants receive an initial EAD that is valid for more than one year? Does this apply to all I-485 applicants (family-based and employment-based)?
Response: Further information will be provided once a final decision is made

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Please advice how to proceed to get this process done properly, legally and fast, reasonably possible and how much time it would probably take. Thanks in advance!
Try EB-3, the ride will be much more fun and exciting compared to EB-2. did you go to Universitatea din Bucuresti?

I think if the I140 is cancelled you can't port the priority date unless. If you would have applied for I485 than that is different case.

Simply going by the voting standpoint, I think between now and 08 elections, politicians will have little incentive do anything about our case (i.e., legal immigration) realistically. I'm not sure whether we represent a % of voter population that's high enough for them to place our case on their priority list. Moreover, giving us GC now will probably benefit them (in terms of votes) at least after 5.5 years once the GC holders are citizens and hence able to vote.
Just my thought for what its worth.
